Fly Fishing Day Lease

$125.00 per Angler

We fish daily from October 1- June 21. We restrict the number of anglers that fish our 2.5 miles of stream and 3 spring ponds to eight anglers.  Our hours of operation are 8am to 7pm.

Our policy is to take payment in full with all bookings due to our short season and limited number of anglers who fish with us each day.  We do not allow cancellations, however we will permit a one time rebooking with 14 days notice.

We reserve the right to close our stream if we deem the water/weather conditions warrant such action. We will make a reasonable effort to inform our anglers of unfishable conditions by messaging and/or phone.

DAY LEASE AGREEMENT AND WAIVER OF LIABILITY

The undersigned acknowledges by his/her printed name below that they have read and understand the following and, further accepts and agrees to all terms and conditions set forth below:
  • 1. This Day Lease contract is by and between Escatawba Farms/Derrick E. Barr, hereafter referred to as the Lessor and Lessee.

  • 2. The term of this contract shall be one day and the Lessee agrees to vacate the property prior to nightfall.
    3. Catch and Release Fly Fishing using barbless hooks is allowed by written permission only (as evidenced by the signature of the Lessor).
    4. The Lessee agrees to use only the lands adjacent to the waters of Dunlap Creek on Escatawba Farms and certifies that all licenses required by law have been obtained. The Lessee further certifies that he/she has no physical restrictions which could prohibit participation in the sport of Catch and Release Fly Fishing.
    5. This Day Lease agreement and Waiver of Liability is applicable to all land owned by the Lessor. While both guided and unguided Catch and Release Fly Fishing is permitted, The Lessor makes no representations or warranties, implied or otherwise, as to the existing conditions of the land. Said land i maintained as a working farm on which many hazardous activities occur and not all potentially dangerous conditions are readily apparent, including but not limited to: irregularities in the stream bed and land, obstructions including fencing, natural debris, and slick surfaces.
    6. The undersigned and/or parent or guardian of any minor child or person entering upon such lands for any activity, enters at his/her own risk, impliedly accepts such land or activities in existing conditions and recognizes that all outdoor pursuits performed in association with this day lease are potentially dangerous. Certain risks are inherent in any outdoor activity and cannot be eliminated without destroying the unique character of the activity. These inherent risks are some of the same elements that contribute to the unique character of the activity and can be the cause of loss or damage to my equipment, or accidental injury, illness or in extreme cases permanent trauma or death.
    7. I, myself or as parent of guardian of any accompanying minor, unconditionally release and hold harmless Lessor, it's agents, servants or employees, against and for all liability, costs, expenses, claims and damages for which it might otherwise become liable by reason of any accident, common illness or injuries to, or death of any persons, or damage to property, or both in any manner arising or resulting from, caused by, connected with or related to the presence of any such persons upon such lands or premises or participation in any activity.
    8. The Lessee further agrees to keep this document on his person at all times while he/she is Fly Fishing on the property of the Lessor.
